TinyChat values our users privacy and protection of their data, we build our apps and operate our business with this in mind.

TinyChat is a property of Paltalk Inc. who also operates Camfrog, TinyChat, Paltalk, and Vumber. Your services are provided by Paltalk Inc. who also acts as a data controller for your information.

This privacy policy applies to all of TinyChat’s services. By using TinyChat you agree to this Privacy Policy as well as our Terms of Service.

As part of providing a great experience for you this sometimes requires us to collect personal information from you. We have done our best to give you control and access to your data where possible and we want you to be aware how that data is being used. This policy will cover:

1. Information you voluntarily provide

To register and interact with members on the site, many times you will be prompted to share information with us to improve your experience while using the product. Some of the information you may share with us includes:

If you specifically desire, we will use your social networking data to allow you to create an account with data you have on another site. Your payment information is used when you decide to purchase premium parts of the Service. Information shared with customer support will be used solely to address the issue(s) you have brought to our attention.

2. Information we collect about you and your device

When you use TinyChat and interact with our services, we may use technology to collect information about your activity. Some of the data that is collected while using the website and mobile/desktop clients may include:

  • Number of sessions per browser/client on each device

OUR USE OF AGGREGATED AND ANONYMIZED INFORMATION

We may share anonymized usage data which does not identify you specifically with third parties. We may combine your data with those of other users of Paltalk Inc. and share this information in aggregated and anonymized form with third parties to help us improve the design and delivery of our software tools, increasing the effectiveness for all users.

OUR USE OF COOKIES, PIXELS AND LOCAL STORAGE

HTML5 Local Storage is a small database located inside your browser which web pages can use to store data to speed up their processing. KEEPING INFORMATION SECURE

Information you provide to us is stored on servers owned and operated by Amazon Web Services, Inc. More information on this provider is available at https://aws.amazon.com. We use many best practice security measures to keep this data safe including private networking, firewalling, role based access controls, authentication, backups and monitoring. When your data is moved off of our servers for any reason we leverage the best means available to us to make sure your data is secure in transit.

We think it is important that you are able to control your personal information.

You have the right to ask us not to process your personal information for marketing purposes. You can exercise your right to prevent such processing at any time by contacting us HERE.

The law gives you the right to request a copy of the personal information we hold about you. We may request additional information about you to verify your identity before we do such. We will supply, correct or delete personal information about you on our files. In addition, you may request rectification or erasure of personal information as well as the restriction of processing of your personal information. YouTube API Services

Tinychat allows users to host a YouTube watch party, which makes use of YouTube API Services. You can learn more about YouTube API Services privacy policy at http://www.google.com/policies/privacy. Tinychat uses the YouTube API Services to allow group viewing of YouTube videos. Tinychat does not retain or track your YouTube API Services history.

CHANGE OF CONTROL

If the ownership of our business changes, we may transfer your information to the new owner so they can continue to operate TinyChat and provide services. The new owner will be obliged to comply with this Policy.

CHANGES TO OUR POLICY

Any changes we may make to this Policy will be posted on this page. Where it makes sense because the changes are material, we will notify you by e-mail or in another appropriate manner such as when you next interact with TinyChat.

SURVEYS AND PROMOTIONS

From time-to-time we may request information from you via surveys, contests or sweepstakes. Participation is completely voluntary. Information collected in any sweepstakes or contest may be used as set forth in this Policy and as described in the official rules, such as to notify the winners, award prizes and file winners’ information, as required by law. Survey information will be used for the purposes of the survey.

ARBITRATION

Any disputes under this Privacy Policy will be resolved in accordance with binding arbitration as outlined in the Terms of Service.

TARGETING AND TRACKING

We may use Tracking Technologies to deliver content, including ads, relevant to your interests on the Services and third party sites based on how you interact with our advertisements or content, and to track the content you access.

To better understand your purchasing preferences, we may also use third party vendors that provide tracking tools that recognize and collect usage and interest information across the sites you’ve visited from your various Devices. When you visit the Services on a specific Device, a unique ID is created for that Device which may be based on your hashed (de-identified) email address. This allows us and our third party vendors to deliver relevant product recommendations, personalized content and advertising to you based on your interests gathered across multiple sites. This data may be combined with the same information from another browser or Device if you use multiple browsers or Devices. Third party tracking tools might also obtain information about other applications that you have downloaded to your mobile Device, the websites you visit and other information about you or your Device in order to analyze and serve anonymous targeted advertising on the Services and elsewhere.

INTERNET ADVERTISING

We or our advertising partners may use Tracking Technologies to collect Information about your visits over time and across the Services and other third-party websites, and combine that information with other information received from other sources, in order to serve more targeted advertising to you. For example, we use Google interest based cookies to serve personalized ads to you. Our ad partners automatically receive your IP address or Device identifier when this happens. Their tools may also limit the number of times you see the same ad and help measure the effectiveness of our advertising campaigns. These third parties may also use information gathered from your use of the Services to serve targeted, interest based advertisements from other advertisers to you on third-party websites and applications.

The Digital Advertising Alliance (“DAA”) has also made available for consumers tools on which you can register your choices not to be tracked by participating advertising networks or companies in the collection and use of your online activities. These are (1) The DAA Consumer Choice Page for Mobile Web and (2) DAA AppChoices, which is a mobile app that allows you to opt out of the collection and use of cross-app data, other than for permitted uses, by listed third-party AppChoices participants. You may opt out of mobile-app targeted advertising ads from any or all of the listed participating advertising networks. You can download the free mobile app from an app store available on your mobile platform. When you opt out with a particular participating advertising network, the mobile app adds your device identifier to that participant’s opt-out list. The participant advertising network is then notified to block the device identifiers on the opt-out list. You can also prevent your receipt of interest-based ads on websites by deleting and declining cookies in your browser(s). Note that your opt-out choice is applied only to the browser from which you make the choice.

Some newer mobile device operating systems allow you to limit the use of information to deliver interest-based advertising in mobile applications, or your mobile web browser may provide a “Do Not Track” browser setting which will notify those ad servers and networks who recognize the signals to refrain from sending you interest based ads to your mobile device. You can check the settings on your device for such options in your device’s operating system. Alternatively, you may wish to download the TrustE mobile application and/or the Digital Alliance “App Choices” mobile application and follow the instructions provided.

If you opt-out of receiving targeted ads on our Services, you may continue to receive advertising and promotional messages after you opt-out, but they will not be customized or personalized to you based on your use of our Services.

Tinychat Co. (d/b/a Tinychat.com) (“Tinychat” or “we”) provides group video chat and other online audio, video broadcasting and communication services for individuals, businesses, and organizations (the “Services”) through our website accessible at www.tinychat.com (the “Site”) and third party websites on which Embed Code (as defined herein) is installed to present certain group video chats. Please read carefully the following terms and conditions (“Terms of Service”). These Terms of Service govern your access to and use of the Site and the Services and, except as otherwise provided in these Terms of Service, all text, graphics, images, music, software, URLs, audio, video, information or other materials available through the Site and Services (“Content”), and constitute a binding legal agreement between you and Tinychat.

Certain areas of the Site (and your access to or use of certain Services or Content) may have different terms and conditions posted or may require you to agree with and accept additional terms and conditions. If there is a conflict between these Terms of Service and terms and conditions posted for a specific area of the Site, Services or Content, the latter terms and conditions shall take precedence with respect to your use of or access to that area of the Site, Services or Content.

Tinychat reserves the right, at its sole discretion, to modify, discontinue or terminate the Site or Services or to modify these Terms of Service, at any time and without prior notice. If we modify these Terms of Service, we will post the modification on the Site or provide you with notice of the modification. We will also update the “Last Updated Date” at the top of these Terms of Service and/or the home page of the Site. By continuing to access or use the Site or the Services after we have posted a modification on the Site or have provided you with notice of a modification, you are indicating that you agree to be bound by the modified Terms of Service. If the modified Terms of Service are not acceptable to you, your only recourse is to cease using the Site and the Services.

Eligibility

The Site and Services are intended solely for persons who are 18 or older. Any access to or use of the Site or Services by anyone under 18 is expressly prohibited. By accessing or using the Site or Services you represent and warrant that you are 18 or older.

Account Registration

In order to access certain features of the Site and Services, you must register to create an account (“Account”) and become a “Member.” To become a Member you must be at least 18 years old. Any registration by anyone under 18 is void. By completing the registration process to create an Account, you represent and warrant that you are 18 or older. During the registration process, you will be required to provide certain information and you will establish a username and a password. You agree to provide accurate, current and complete information during the registration process and to update such information to keep it accurate, current and complete. Tinychat reserves the right to suspend or terminate your Account if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete. You are responsible for safeguarding your password. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your Account, whether or not you have authorized such activities or actions. You will immediately notify Tinychat of any unauthorized use of your Account.

Social Media and Networking Sites

As a Member, you have the option of granting Tinychat access to your accounts with certain third-party social media and networking sites (each, an “SNS”) so that Tinychat can capture and make available on the Site and through the Services content that you have stored in your account(s) with such SNSs (“Member SNS Content”). By granting Tinychat access to any such Member SNS Content, you understand that Tinychat will access, make available and store (if applicable) such Member SNS Content so that it is available on the Site and through the Services. Tinychat is not responsible for any Member SNS Content stored on an SNS that you choose to make available on the Site and through the Services. Please note that if an SNS account becomes unavailable or an SNS terminates Tinychat’s access to your SNS account(s), any Member SNS Content from that SNS will no longer be available on the Site and through the Services. You have the ability to disable the connection between the Site and Services and your SNS accounts, at any time, by accessing the “Settings” section of the Site. PLEASE NOTE THAT YOUR RELATIONSHIP WITH EACH SNS, INCLUDING YOUR RIGHTS WITH RESPECT TO ANY CONTENT THAT YOU PROVIDE TO AN SNS AND THE STORAGE OF SUCH CONTENT, IS GOVERNED SOLELY BY YOUR AGREEMENT(S) WITH SUCH SNS.

Chatrooms

l enable you to join chatrooms created on the Site. As a Member, the Service will also allow you to create a chatroom that other users of the Site will be able to join. The chatrooms allow you to video chat live with other users of the Site, and you may also correspond by writing and sending comments that are displayed to other Members in a chatroom or a private message to a specific user in a chatroom. By creating a chatroom, you agree to act as the administrator of it and to take the responsibility to moderate such chatroom. You agree to exclude and flag any participant that you believe is in breach of these Terms of Service or who is otherwise acting inappropriately. If someone reports any content of your chat as illegal, infringing or otherwise in breach of these Terms of Service, you will be responsible for taking such content down.

Payment Terms of Service

The Services are currently made available without charge. However, Tinychat reserves the right to charge for your use of the Services at any time. Tinychat will provide appropriate notice to you if it elects to charge for use of the Services or parts thereof.

Ownership

The Site, Services, Embed Code and Content are protected by copyright, trademark, and other laws of the United States and foreign countries. Except as expressly provided in these Terms of Service, Tinychat and its licensors exclusively own all right, title and interest in and to the Site, Services and Content, including all associated intellectual property rights. You will not remove, alter or obscure any copyright, trademark, service mark or other proprietary rights notices incorporated in or accompanying the Site, Services or Content.

Content License

Subject to your compliance with the terms and conditions of these Terms of Service, Tinychat grants you a limited, non-exclusive, non-transferable license, without the right to sublicense, to access and view Content solely to use the Site and Service for your personal and non-commercial purposes. Subject to your compliance with the terms and conditions of these Terms, Tinychat grants you a limited, non-exclusive, non-transferable license, without the right to sublicense, to access and view any User Content solely for your personal and non-commercial purposes. Without limiting your rights to your own User Content (as defined in the following paragraph), you will not use, copy, record, adapt, modify, prepare derivative works based upon, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast or otherwise exploit the Site, Services, Content or User Content, except as expressly permitted in these Terms of Service. User Content

Members may post, upload, publish, broadcast, stream, display, submit or transmit text, words, verbal statements, graphics, images, music, software, audio, video, information or other materials to be made available through the Site and Services (“User Content”). By making available any User Content through the Site and Services, you hereby grant to Tinychat a worldwide, irrevocable, perpetual, non-exclusive, transferable, royalty-free license, with the right to sublicense, to use, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast and otherwise exploit such User Content on, through or by means of the Site, the Services, and third party websites. Tinychat does not claim any ownership rights in any such User Content and nothing in these Terms of Service will be deemed to restrict any rights that you may have to use and exploit any such User Content. You acknowledge and agree that you are solely responsible for all User Content that you make available through the Site or Services. Accordingly, you represent and warrant that: (i) you either are the sole and exclusive owner of all User Content that you make available through the Site or Services or you have all rights, licenses, consents and releases that are necessary to grant to Tinychat the rights in such User Content, as contemplated under these Terms of Service; and (ii) neither the User Content nor your posting, uploading, broadcasting, publication, streaming, submission or transmittal of the User Content or Tinychat’s use of the User Content (or any portion thereof) on, through or by means of the Site, the Services, or third party websites will infringe, misappropriate or violate a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

Feedback

We welcome and encourage you to provide feedback, comments and suggestions for improvements to the Site and Services (“Feedback”). You may submit Feedback by emailing us at feedback@tinychat.com or through the “Help” section of the Site. You acknowledge and agree that all Feedback will be the sole and exclusive property of Tinychat and you hereby irrevocably assign to Tinychat and agree to irrevocably assign to Tinychat all of your right, title, and interest in and to all Feedback, including without limitation all worldwide patent rights, copyright rights, trade secret rights, and other proprietary or intellectual property rights therein. At Tinychat’s request and expense, you will execute documents and take such further acts as Tinychat may reasonably request to assist Tinychat to acquire, perfect, and maintain its intellectual property rights and other legal protections for the Feedback.

Embed Code

If you are a Member, and subject to your compliance with these Terms of Service, Tinychat grants you a non-exclusive, non-transferable license to copy the software code it makes available when click the “embed code” option on the Website (the “Embed Code”) solely to install the Embed Code on your website for purposes of presenting a group video chat through your website that you created or moderate through the Service. Except as expressly specified in these Terms of Service, you may not: (a) copy (except in the course of loading or installing) or modify the Embed Code, including but not limited to adding new features or otherwise making adaptations that alter the functioning of the Embed Code; (b) transfer, sublicense, lease, lend, rent or otherwise distribute the Embed Code to any third party; or (c) disassemble, decompile or reverse engineer the Embed Code, in whole or in part, or permit or authorize a third party to do so, except to the extent such activities are expressly permitted by law notwithstanding this prohibition.

General Prohibitions

You agree not to do any of the following:

  • Post, upload, publish, broadcast, stream, display, submit or transmit any text, words, statements, conversations, graphics, images, software, music, audio, video, information or other material that: (i) infringes, misappropriates or violates a third party’s patent, copyright, trademark, trade secret, moral rights or other intellectual property rights, or rights of publicity or privacy; (ii) violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability; (iii) is fraudulent, false, misleading or deceptive; (iv) is defamatory, obscene, pornographic, sexually explicit, nude, vulgar or offensive; (v) promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group; (vi) is violent or threatening or promotes violence or actions that are threatening to any other person; or (vii) promotes illegal or harmful activities or substances;

  • Bully, abuse, harass, stalk, demean, threaten or discriminate against others;

  • Discuss illegal activity, such as how to obtain or consume illegal drugs and how to make bombs;

  • Ask for or offer sexually explicit images, and/or material harmful to children;

  • Use, display, mirror or frame the Site, or any individual element within the Site, Tinychat’s name, any Tinychat trademark, logo or other proprietary information, or the layout and design of any page or form contained on a page, without Tinychat’s express written consent;

  • Access, tamper with, or use non-public areas of the Site, Tinychat’s computer systems, or the technical delivery systems of Tinychat’s providers;

  • Attempt to probe, scan, or test the vulnerability of any Tinychat system or network or breach any security or authentication measures;

  • Avoid, bypass, remove, deactivate, impair, descramble or otherwise circumvent any technological measure implemented by Tinychat or any of Tinychat’s providers or any other third party (including another user) to protect the Site, Services or Content;

  • Attempt to access or search the Site, Services or Content or download Content from the Site or Services through the use of any engine, software, tool, agent, device or mechanism (including spiders, robots, crawlers, data mining tools or the like) other than the software and/or search agents provided by Tinychat or other generally available third party web browsers;

  • Send or broadcast any unsolicited or unauthorized advertising, promotional materials, email, junk mail, spam, chain letters or other form of solicitation;

  • Use any meta tags or other hidden text or metadata utilizing a Tinychat trademark, logo URL or product name without Tinychat’s express written consent;

  • Use the Site, Services or Content for any commercial purpose or the benefit of any third party or in any manner not permitted by these Terms of Service;

  • Forge any TCP/IP packet header or any part of the header information in any email or newsgroup posting, or in any way use the Site, Services or Content to send altered, deceptive or false source-identifying information;

  • Attempt to decipher, decompile, disassemble or reverse engineer any of the software used to provide the Site, Services or Content;

  • Interfere with, or attempt to interfere with, the access of any user, host or network, including, without limitation, sending a virus, overloading, flooding, spamming, or mail-bombing the Site;

  • Collect or store any personally identifiable information from the Site or Services from other users of the Site or Services in breach of any data protection laws or privacy laws;

  • Impersonate or misrepresent your affiliation with any person or entity;

  • Violate any applicable law or regulation;

  • Record or otherwise store any video or audio that you perceive or receive through the Site or Services, or record or otherwise store any video or audio interactions you conduct with another Member or user; or

  • Encourage or enable any other individual to do any of the foregoing.

Tinychat has the right to investigate and prosecute violations of any of the above to the fullest extent of the law. Tinychat may involve and cooperate with law enforcement authorities in prosecuting users who violate these Terms of Service. You acknowledge that Tinychat has no obligation to monitor your access to or use of the Site, Services or Content or to review or edit any User Content, but has the right to do so for the purpose of operating the Site and Services, to ensure your compliance with these Terms of Service, or to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body. Tinychat reserves the right, at any time and without prior notice, to remove or disable access to any Content, including any User Content that Tinychat, at its sole discretion, considers to be in violation of these Terms of Service or otherwise harmful to the Site or Services.

Copyright and IP Policy

Tinychat respects copyright law and expects its users to do the same. Limitation of Liability

YOU ACKNOWLEDGE AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ENTIRE RISK ARISING OUT OF YOUR ACCESS TO AND USE OF THE SITE, SERVICES AND CONTENT, INCLUDING USER CONTENT MADE AVAILABLE BY OTHER MEMBERS, REMAINS WITH YOU. IN NO EVENT WILL TINYCHAT’S AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OF SERVICE OR FROM THE USE OF OR INABILITY TO USE THE SITE, SERVICES OR CONTENT EXCEED THE AMOUNTS YOU HAVE PAID TO TINYCHAT FOR USE OF THE SITE, SERVICES OR CONTENT, IF YOU ARE REGISTERED FOR PAID ACCOUNT, OR FIFTY ($50), IF YOU ARE REGISTERED FOR A FREE ACCOUNT, AS APPLICABLE. THE LIMITATIONS OF DAMAGES SET FORTH ABOVE ARE FUNDAMENTAL ELEMENTS OF THE BASIS OF THE BARGAIN BETWEEN TINYCHAT AND YOU. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Digital Millenium Copyright Act

1. If you are a copyright owner or an agent thereof and believe that any User Submission or other content infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

  • A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;

  • Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site;

  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material;

  • Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail;

  • A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law;

  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2. Counter-Notice. If you believe that your User Submission that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the content in your User Submission, you may send a counter-notice containing the following information to the Copyright Agent:

  • Your physical or electronic signature;

  • Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;

  • A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content;

  • Your name, address, telephone number, and e-mail address, a statement that you consent to the jurisdiction of the federal court in San Francisco, California, and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

If a counter-notice is received by the Copyright Agent, Tinychat may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at Tinychat's sole discretion.

Proprietary Rights Notices

All trademarks, service marks, logos, trade names and any other proprietary designations of Tinychat used herein are trademarks or registered trademarks of Tinychat. Any other trademarks, service marks, logos, trade names and any other proprietary designations are the trademarks or registered trademarks of their respective parties.

Controlling Law and Jurisdiction

These Terms of Service and any action related thereto will be governed by the laws of the State of New York without regard to its conflict of laws provisions. The exclusive jurisdiction and venue of any action with respect to the subject matter of these Terms of Service will be the state and federal courts located in the Southern District of New York and each of the parties hereto waives any objection to jurisdiction and venue in such courts.

Entire Agreement

These Terms of Service constitute the entire and exclusive understanding and agreement between Tinychat and you regarding the Site, Services, Content and User Content, and these Terms of Service supersede and replace any and all prior oral or written understandings or agreements between Tinychat and you regarding the Site, Services, Content and User Content.

Assignment

You may not assign or transfer these Terms of Service, by operation of law or otherwise, without Tinychat’s prior written consent. Any attempt by you to assign or transfer these Terms of Service, without such consent, will be null and of no effect. Tinychat may assign or transfer these Terms of Service, at its sole discretion, without restriction. Subject to the foregoing, these Terms of Service will bind and inure to the benefit of the parties, their successors and permitted assigns.

Notices

Any notices or other communications permitted or required hereunder, including those regarding modifications to these Terms of Service, will be in writing and given: (i) by Tinychat via email (in each case to the address that you provide) or (ii) by posting to the Site. For notices made by e-mail, the date of receipt will be deemed the date on which such notice is transmitted.

General

The failure of Tinychat to enforce any right or provision of these Terms of Service will not constitute a waiver of future enforcement of that right or provision. The waiver of any such right or provision will be effective only if in writing and signed by a duly authorized representative of Tinychat. Except as expressly set forth in these Terms of Service, the exercise by either party of any of its remedies under these Terms of Service will be without prejudice to its other remedies under these Terms of Service or otherwise. If for any reason a court of competent jurisdiction finds any provision of these Terms of Service invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the other provisions of these Terms of Service will remain in full force and effect.
